Terms of Use

This translation is provided for convenience. In case of any discrepancy, the Russian version prevails.

1. General

These Terms govern the use of the website discomagic.ru and its subdomains (the "Site"). The Site is owned and administered by Sergey Aleksandrovich Vorobiev, a private individual (the "Operator"). Contact: admin@discomagic.ru.

The Site is non-commercial: music, radio, articles and other material are free, no goods or services are sold and no advertising is shown. By using the Site you accept these Terms and the Privacy Policy. If you do not agree, stop using the Site.

The Site is intended for persons over 16 (rated 16+). Persons under 16 may use the Site with the consent of a parent or other legal guardian.

2. Account

Listening to music and reading articles require no registration. Downloading tracks, comments, Club chat, playlists and favourites require a free account. You can register with an email address (with verification) or via VK ID.

You must provide accurate details, keep your password secret and not share access to your account. Everything done under the account is deemed done by its owner until the Operator is notified of a compromise. You may delete your account in profile settings at any time; the consequences are described in the Privacy Policy.

3. User content

By posting comments, chat messages, playlists, reactions and ideas you keep your rights to them and allow the Operator to display them on the Site free of charge, without limitation of term or territory, until you or the Operator delete them. You are responsible for what you post and confirm that you are entitled to post it.

Prohibited: material that violates the laws of the Russian Federation or the rights of third parties; spam and advertising; insults, harassment, incitement of hatred; impersonation; third parties' personal data without their consent; malicious links and code; actions that disrupt the Site or bypass its restrictions.

The Operator may, without notice, hide or delete any material, restrict chat access, suspend or block an account for violating these Terms or the law. Any chat message can be reported; reports are reviewed by an administrator.

4. Disco Magic material and rights

Music, lyrics, images, articles, the project name and design are protected by intellectual property law and belong to the project members or are used with the permission of the rights holders. Covers and remixes are based on the members' own compositions or made with the rights holder's permission. Some material is created with the Suno service under its terms; mentioning Suno does not imply its participation in or endorsement of the project.

You may listen to tracks and download them for personal non-commercial listening. Without the Operator's written permission you may not republish material on other platforms, sell it, use it in commercial projects, create derivative works, use it to train machine-learning models, or download the catalogue in bulk or by automated means, except for the archives the Site offers itself.

Links to music platforms (VK Music, Yandex Music, Apple Music and others) lead to third-party services governed by their own rules. Where a platform is listed in the Russian register of foreign agents, the link carries the label required by law.

5. Donations

You can support the project with a one-off donation via Donation Alerts. A donation is voluntary, is not payment for goods, services or a subscription, unlocks no additional features and is non-refundable except as provided by the payment service's rules. Payment is processed on the service's side under its terms.

The name, amount and message entered with a donation are published on the "Support" page. If your name matches your nickname on the Site, your account receives the "Patron" badge. To hide an entry, write to admin@discomagic.ru.

6. Restrictions and technical protection

The Operator applies rate limiting, SmartCaptcha checks, activity gates before archive downloads and other measures against bots and bulk downloading. Attempts to bypass these measures, scraping, password guessing and other interference with the Site are prohibited and may lead to blocking by IP address or account.

7. Third-party services

The Site uses third-party services (VK ID, Yandex.Metrica, Yandex SmartCaptcha, Donation Alerts) and links to external resources. Their operation, availability and data handling are governed by their own rules. The Operator does not control third-party services; those that receive user data are listed in the Privacy Policy.

8. Liability

The Site is provided "as is". The Operator takes reasonable steps to keep it available and secure but does not guarantee uninterrupted operation, preservation of playlists and favourites, or compatibility with every device. The Operator is not liable for user content before a report is received, nor for third-party services. Nothing in these Terms limits liability that cannot be excluded by law.

9. Rights holder requests

If you believe material on the Site infringes your rights, write to admin@discomagic.ru with a link to the material, the grounds for your request and your contact details. The Operator handles such requests under Article 15.7 of Russian Federal Law No. 149-FZ of 27 July 2006 and restricts access to the material where the request is justified.

10. Changes, governing law, disputes

The Operator may amend these Terms by publishing a new version on this page with the update date; continued use of the Site means acceptance of the changes. The laws of the Russian Federation apply. Disputes are resolved by negotiation; a claim sent to admin@discomagic.ru is considered within 30 days, after which the dispute may be referred to a court under the jurisdiction rules of Russian law.
